APPEALS / SPECIAL CASES

Residence appeals

Many migrants are coming to New Zealand hoping to get residence sometime in the future. Applying for residence is complicated and it can take one year or longer before your application is being assessed. You may even need to reapply for a new visa so you can stay in New Zealand while waiting to hear from Immigration New Zealand. And after all that you may find out that your application was unsuccessful.

However, Immigration New Zealand does not always get it right. You have a right to appeal your case to the Immigration and Protection Tribunal if you believe that your application was wrongly decided. Keep in mind that you only have limited time to appeal the decision.

To be successful with an appeal, we need to point out the errors that were made when deciding your visa application and show how these errors affected the outcome of your case.  Contact us to discuss your options. At bkimmigrationlaw we give you clear and honest legal advice whether your case merits an appeal so you can make an informed decision.

APPEALS AGAINST DEPORTATION

You may be a non-resident, resident or permanent resident and are facing deportation from New Zealand. There are different reasons why you can be deported. For example, your visa has expired, or you have a valid visa but broke the law which can be as simple as committing a traffic offence. Or you breached a visa condition like changing the employer or location contrary to what is stated on your visa.

If you received a deportation liability notice from Immigration New Zealand, then you have a right to appeal to Immigration and Protection Tribunal.  Keep in mind, all appeals must be filed within a short time frame.

Your appeal may be allowed if you can demonstrate that you have exceptional circumstances. Exceptional circumstances are not just separation from your family. This means your circumstances must be well outside of what is the norm.

If you are facing deportation, we advise that you contact us without delay.

EMPLOYMENT LAW

All employees in New Zealand including migrants have employment rights which are set out in various legislation and your employment agreement. Among these rights is a process that should be followed when employment problems or disputes arise. In an ideal work environment, we would discuss our employment problems early and openly with the employer to find a resolution. However, migrants often feel that they cannot speak up for fear of losing their job.

Please talk to us If you feel that you are being treated unfairly, discriminated or harassed at work, or were dismissed from work without a valid reason or fair process, or you are uncertain about your employment rights.  We can help you to understand your rights, explain your options and assist you finding a solution. We can also help you to pursue a personal grievance claim against the employer with the Employment Relations Authority without compromising your immigration status in New Zealand.
